Thank you for your email concerning the article in Aftonbladet on 17 August.

We understand that what was written in the article has stirred up strong feelings. We must all be alert to anything that may be perceived as anti-Semitism. Dissemination of anti-Semitic statements is classed in Swedish law as incitement to racial hatred, an offence that can be punished by up to two years in prison. The political parties in the Riksdag stand united in their condemnation of all forms of anti-Semitism.
Swedish schools engage in extensive educational work on issues such as the Holocaust. There is also a special state institution – the Living History Forum – that is responsible for spreading information about the Holocaust.

Many people have demanded that the Swedish Government repudiate the article.

The Swedish Constitution lays down a division of roles with regard to publication in the media, according to which the role of the legally responsible publisher can never be assumed by the Government or a government agency. The legally responsible publisher of the newspaper is the only party that can be held responsible for publication. The Chancellor of Justice is the only party that can bring an action for an offence against the Freedom of the Press Act, which is part of the Constitution. In such a case, the charge may be incitement to racial hatred. Neither the Government nor an individual minister may,

suite ;
in the event of any such suspicion, attempt in any way to influence the handling of the matter by the judicial authorities, for example, by making a statement or condemning what has been done. Anyone who is of the opinion that such an offence has been committed can report the matter to the Office of the Chancellor of Justice. Individuals who feel that they have been or are being subjected to defamation or insults can apply to a general court. Apart from the provisions of the Freedom of the Press Act, the media are subject to the supervision of the Swedish Press Council, to which anyone can complain about the contents of an article.

It is because of this division of roles that the Government does not criticise, apologise for or condemn individual newspaper articles.
The Office of the Chancellor of Justice is currently examining the question of whether the contents of the article may constitute a criminal offence. The action of the Swedish Ambassador in Tel Aviv is being examined by the Parliamentary Ombudsman and the Government’s management of the matter will be examined by the Riksdag Committee on the Constitution.

Minister for Foreign Affairs Carl Bildt has discussed the issue in his blog on 20 and 22 August. An English and Hebrew translation of these blog entries are hereby attached.

Yours sincerely,

Annika Ben David
Counsellor and Deputy Head of Mission
Embassy of Sweden
Tel Aviv

Réponses officiel du gouvernement suèdois :

Principle and practice
20 August 2009
Suddenly we were hit by a double media storm in the wake of a previously unnoticed article in the cultural pages of Aftonbladet a few days ago.
It is not difficult to understand how the author’s accusations aroused strong feelings in Israel. Bitter historical experience has led to a natural and strong sensitivity to insinuations or accusations that might encourage open anti-semitism.
And it is certainly true that we must all be strongly on our guard against anything that can be construed as anti-semitism. I also think that this is something that we are across Swedish society.
I have never seen such complete unanimity on any other issue I have discussed in the Riksdag as in condemning all forms of anti-semitism.
There have been demands from some circles in Israel that we somehow publicly distance ourselves from this article or even intervene to prevent such articles from being published.
But that is not how our country works – nor should it do so.
If I were to devote my time to correcting every odd debate article in the various media, I would not have much time left over to do anything else. And criticism against any one of them could be interpreted as me thinking that all the others are all right.
There is a very strong, traditional freedom of expression and the press enshrined in our constitution. And this strong protection has served our democracy and our country well.

Various regimes have, at various times, attempted to get various Swedish governments to limit the press’s right to criticise and freedom. And the conclusion we have all drawn from these events is that it is important that we have the strong constitutional protection we have in place.
Protection against lack of judgement or taste or breaches of basic values in our society is primarily and most effectively to be found in free and critical discussion itself.
When, some time ago, there was an agitated debate surrounding what was considered by many to be public defamation of Islam and the prophet Mohammed, I believe that we gained understanding for the fact that it is through openness that we are best able to build the tolerance and understanding that are so important in our society.
I believe that this is also true in this case.
However, both this storm and the earlier one – where the focus was on other parts of the Middle East – demonstrate that we live in a world where public debate also spills over old boundaries and where we all, in different contexts, do well to be aware of historical, national and religious sensitivities.
We also do well to remember the importance of adhering to the principle of freedom of expression and of the press that is such an essential part of our democracy.
